WASHINGTON – U.S. Senator Kevin Cramer (R-ND) joined Senators Mike Lee (R-UT) and Senators Shelley Moore Capito (R-WV) in introducing the Working Families Flexibility Act, legislation to give employees more flexibility on how to use their overtime benefits. 

“Because of onerous and arbitrary federal regulations, employees don’t have a say in how they are compensated for overtime work,” said Senator Cramer. “The Working Families Flexibility Act eliminates this decades-old law forcing employers to choose between extra pay and extra time off. This will allow employers to create more hiring incentives and give employees more control over their compensation.”

The Working Families Flexibility Act fixes this disparity by amending the Fair Labor Standards Act of 1938 to provide employers with the necessary flexibility to allow their employees to choose either the traditional overtime pay or paid time off for any overtime hours worked.

Senators Cramer, Lee, and Capito are joined on the bill by Senators Tim Scott (R-SC), James Risch (R-ID), John Barasso (R-WY), Mitt Romney (R-UT), Roger Wicker (R-MS), Jim Inhofe (R-OK), Chuck Grassley (R-IA), Mike Crapo (R-ID), John Cornyn (R-TX), and James Lankford (R-OK).
